US Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without legal authority.
"Since his return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.
The case stems from a mistaken deportation to El Salvador in March, which the government later admitted was an error. After his repatriation to the United States to answer alien smuggling charges, he was detained in federal detention.
In her decision, the judge noted that the government does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."
Background of the Legal Challenge
The court proceedings center on disputed claims. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this claim.
He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in Tennessee.
Terms of Freedom
The judge, who was hearing his petition to deportation in a federal court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This decision effectively transfers his monitoring to the jurisdiction handling his criminal case.
This decision represents a significant turn in a complex immigration battle featuring allegations of wrongful detention and disputed gang associations.
